My wife and I are having extraordinary high expenses for the past few months here in Montgomery, Alabama. We see that our car insurance is a potential expenditure that we can cut off the cost. How can we lower the amount of our car insurance premium payment?

Daniel

Montgomery, AL

Given your case, you don’t have to worry because there are a lot ways wherein you can decrease the cost of your car insurance policy there in Montgomery, Alabama. You can claim discounts from your insurance providers in many occasions. But you need to be acquainted to the guidelines of these insurance companies because there could be discrepancies in the instances when they can give discounts. But typically, discount opportunities are offered to car insurance clients who are with return or long period of subscription to an insurance company. For instance, a five-year subscription of a policyholder can claim a particular discount rate from his/her insurer; also repeat clients like those who only insure their car at particular season in the year.

Other discounts are usually given when you have multiple cars or drivers you include to your car insurance policy. Your car’s features that may reduce instances of theft, vandalism, serious property damages and bodily injuries such as anti-lock brakes, air bags and alarm devices can also lower your car insurance premium costs. If your sons and daughters are already able to get their own student driver’s license and if they have good grade point average in school, you can also include them in your policy to be granted of discounts.

Reader’s Question:

I am really trying very hard so that my auto insurance company doesn’t find out about my DUI conviction here in Montgomery, Alabama? Is there a way that I can keep them from finding out about my drunk driving conviction so that I won’t have higher rates?

Ben

Montgomery, AL

You can keep your drunk driving conviction in Montgomery, Alabama but it won’t take long before your auto insurance provider finds out about it because you would have to file for an SR22 insurance sooner or later so that your driver’s license will be reinstated. SR22 form is a requirement for drunk driver in the state of Alabama so in most circumstances, you can’t stay away from them finding out about your drunk driving conviction. The SR22 insurance could also be a reason for your auto insurance provider to cancel your policy at the end of your coverage.

Your auto insurance provider will be required to notify you through a letter if your policy will be cancelled. If this happens, you will be forced to find another auto insurance provider while you have a policy cancellation on your record. In some other circumstances, the auto insurance provider may not be offering policies with SR22 insurance so this is another reason for your policy to be cancelled or not renewed. Auto insurance providers may keep higher insurance rates for three years because of your drunk driving conviction.

I was hoping I could find lower rate car insurance policy here in Montgomery, Alabama. How do you think I can compare auto insurance policies from different companies?

Apple

Montgomery, AL

Auto insurance policies have a lot of terms and coverage options. You have to have a dash of financial and legal knowledge to select a policy that is suitable for your needs. Most auto insurance agents are willing to provide you information about multiple options and quotes for possible coverage. However, they want you to purchase a policy from them, so shop around and get information from different agents.

You can consider the brand name of the company while comparing auto insurance quotes in Montgomery, Alabama. A company that has a good reputation in the marketplace makes them dependable and credible and that would help you when making claims. You can also check the deductible when reviewing the auto insurance quotes. Higher deductibles typically mean lower insurance premium rates on your auto insurance. You can opt to have a policy based on lower rates and higher deductibles or higher rates and lower deductibles, which depends on the type of auto insurance you want.

Reader’s Question:

I was told that my auto insurance company can cancel my policy once they find out I have a suspended driver’s license because of a DUI citation here in Montgomery, Alabama. Will they give me a notification or will they cancel it right away?

Valentin

Montgomery, AL

Most of the auto insurance companies could cancel a policy at any time if you have committed one of the “canceled offense,” and one of which is losing your driving privileges due to driver’s license suspension. Having a suspended driver’s license because of your DUI citation in Montgomery, Alabama is a ground for the termination of your auto insurance policy. Your auto insurer can’t just cancel your policy once they find out about your DUI case. They would have to give you a written notice for the cancellation of your auto insurance policy.

State laws vary on the number of days that the auto insurance company should provide notice before the cancellation takes effect, but you can expect that your auto insurer would give you between 10 and 30 days notice. In the notice, the auto insurance company should tell you why it has decided to cancel your auto insurance policy. Now, if having a new insurer is your problem, that can be solved if you get an online rate quote from this website and get great deals for auto insurance in Alabama.

Reader’s Question:

My cousin refused the blood alcohol test when she was arrested for DUI in Montgomery, Alabama. What could she be facing right now and long would the DUI offense stay in her records?

Andy

Montgomery, AL

After your cousin has been arrested for DUI in Montgomery, Alabama, she will be facing two separate cases. The first case would be in the criminal courts and the second one would be administrative hearing with the Alabama Department of Public Safety. It would be crucial for her to contact a lawyer as soon after her arrest because she would only have just 10 days to request the Department of Public Safety hearing. If she fails to do this, she would put her privilege to drive at risk.

Since your cousin refused to submit to a breath, blood or urine test to see how much alcohol was in her system, she would automatically lose her license for at least 90 days. Unfortunately, she may not be allowed to apply for a restricted license. The blood alcohol test refusal can be used against her in court as well. Aside from the basic consequences of a DUI offense in Alabama, her DUI arrest would also cause her to lose her driver’s license. Depending on how many DUI convictions she has on her record, she would face driver’s license suspension of 90 days for first offense, one year for second offense, three years for third offense and five years for fourth offense. A DUI offense would stay on her driving records for five years.

Reader’s Question:

I have never gotten arrested for DUI here in Montgomery, Alabama but I know a lot of people who have been charged with this kind of offense. I’m just really curious because I don’t want the same thing to happen to me. I just wanna know, what happens in a DUI arrest?

Regine

Montgomery, AL

Usually, a driver is being suspected for driving under the influence if he/she is drifting between lanes, stopping abruptly for no reason, swerving erratically while driving, driving at extremely high or low speeds or making excessively wide turns. If you were caught doing at least one of these things, you might just get pulled over and be arrested for DUI in Montgomery, Alabama.

During a DUI arrest, a driver is usually asked to do some tests to prove whether or not he/she has been driving under the influence. The first set of tests would be the Field Sobriety Tests (FST) to test the coordination and balance of the driver. The usual tests that are being done would be the Horizontal Eye Test, the Walk and Turn test, and the One Leg Stand. Each of these tests being conducted is designed so that a sober person will be able to pass without a problem. These tests do not provide the police officer with a specific blood alcohol level but they do allow the officer to pass judgment on the ability of the driver to operate a motor vehicle.

Once the police officer determines that the driver is intoxicated based on these FST, he/she will be asked to take the Breathalyzer test. The driver will breathe into the Breathalyzer and it will compute the blood alcohol level. The driver will be considered legally intoxicated if your blood alcohol is 0.08 or higher. If the driver fails the FST and Breathalyzer, he/she will be read his/her rights and arrested. He/she must remain in jail until someone posts bail and he/she receives a court date for sentencing.

Reader’s Question:

During the arraignment can I represent myself in trial? What can a lawyer do for me? What will is the asking price to get a lawyer in Alabama?

Carrie

Montgomery, AL

These are really good questions. Carrie, you can stand for yourself — though it is not really an excellent idea. DWI is an extremely multifaceted field with more and more harsh penalty. There is a field of complex bureaucratic, evidentiary, legitimate, punishment and administrative license matters. What can a lawyer do for you? In actual honesty, there is nothing. If he is not capable in this extremely specific turf then he really could not help you. A capable attorney, on the other hand, can evaluate the case for imperfections, hold back evidence, force discovery of such things as regulation and maintenance records for the breath machine, have blood samples separately analyzed, bargain for a lesser accusation or reduced sentence, get hold of expert witnesses for trial, and dispute the administrative license suspension.

This differs, of course, by the status and familiarity of the lawyer and by the location of the firm. Generally, the more skilled the attorney is, the more expensive their fees are. An associated factor is the quantity of time a lawyer dedicates to his cases: the good lawyers take less clients, spending more time on each.In Montgomery Alabama the standard range for an attorney is approximately from $1,500 to $2,500. Aspects that may be the basis of the fee to be amplified or reduced include: Is the case a misdemeanor or felony? If former convictions are suspected, the measures for attacking them might put in to the cost. The cost may or might not include hearing or pleas. Expenses such as skilled witness fees, autonomous blood analysis, refurbish of subpoenas, and others may be extra.

What are my rights as the citizen of Alabama regarding DWI?

Jessie

Montgomery Alabama

Jessie, you have a right to remain silent. This means, you do not have to respond to any query which a police officer asks you throughout a Montgomery DWI investigation. You need to remember that everything you say will be used against you. Jessie you are not required to do field sobriety tasks. If you think that you may be under the influence, a polite denial to carry out these tasks will do well to you greatly in the predictable procedures which will follow. Politely say no and look downward or away when the officer tries to carry out the Nystagmus test on your eyes. If it is past dark and you have the smell of an alcoholic beverage on your breath, the officer is going to take you into custody whether or not you believe you have passed the tests.

You have a right to say no to a breath or blood test. You are not obligated to blow into the breathalyzer at the sight of the traffic stop. There is no punishment for this negative response. The consequences of this machine are not allowable in court. If you are asked to carry out a breath test after you are detained and while you are at the police station, you are not obligated to surrender to this test. There is at present no criminal sanction for this negation. On the other hand, there is a possible driver’s license suspension sanction for a negative response.

You have a right to a trial prior to the suspension of your license. Whether you did not succeed a breath test or you say no to a breath test, the Alabama Department of Public Safety will try to suspend your driver’s license. However, they are not at all times successful. You or your legal representative has to request that trial within fifteen days after your detention or the hearing is put aside and your license will be automatically suspended. You have a right to a lawyer and a jury hearing. A lot of people suppose that they have unpromising cases, that a defense is excessively pricey, that the majority of people be beaten their cases, and that a guilty appeal is their most excellent and cheapest alternative. Every one of these anxieties are imprecise notions, or just simply wrong! You are not in a place to critic your case, you require a lawyer.
