<p>After your cousin has been arrested for DUI in Montgomery, Alabama, she will be facing two separate cases. The first case would be in the criminal courts and the second one would be administrative hearing with the Alabama Department of Public Safety. It would be crucial for her to contact a lawyer as soon after her arrest because she would only have just 10 days to request the Department of Public Safety hearing. If she fails to do this, she would put her privilege to drive at risk.</p>
<p>Since your cousin refused to submit to a breath, blood or urine test to see how much alcohol was in her system, she would automatically lose her license for at least 90 days. Unfortunately, she may not be allowed to apply for a restricted license. The blood alcohol test refusal can be used against her in court as well. Aside from the basic consequences of a DUI offense in Alabama, her DUI arrest would also cause her to lose her driver&#8217;s license. <p>The people I talk to who have been arrested for DUI here in Alabama told me about these field sobriety tests being conducted on people suspected for DUI? Is there a scientific basis for these field sobriety tests, could you give some examples and can they be used to determine probable cause to arrest a person?</p>

<p>The field sobriety tests (FST&#8217;s) are generally used by police officers in  Alabama DUI investigations to determine if the driver is under the influence of alcohol. Normally, FST&#8217;s consist of a battery of three to five exercises like walk-and turn, one-leg stand, &#8220;nystagmus,&#8221; finger-to-nose, alphabet recitation, &#8220;Rohmberg,&#8221; etc. The police officer could decide whether the driver &#8220;failed&#8221;, or he may decide after applying recent federal &#8220;standardized&#8221; scoring. But these tests have no real basis in science and are almost useless in a DUI case.</p>
<p>Any police officer or DUI attorney knows that the decision to arrest is made at the driver&#8217;s window and the FST&#8217;s given supposedly to determine probable cause to arrest is actually for the purpose of gathering evidence. The officer actually has already made up his mind in arresting the driver so he will &#8220;see&#8221; what he expects to see. The conditions wherein the FST&#8217;s are taken almost guarantee failure: possibly cold, along a gravel or sloped roadside, usually late at night, with bright headlights from passing cars, the officer&#8217;s flashlight and patrol car&#8217;s strobe and headlights providing the lighting and the driver might be nervous, frightened and completely unfamiliar with the tests.</p>

<p>I have never gotten arrested for DUI here in Montgomery, Alabama but I know a lot of people who have been charged with this kind of offense. I&#8217;m just really curious because I don&#8217;t want the same thing to happen to me. I just wanna know, what happens in a DUI arrest?</p>

<p>Usually, a driver is being suspected for driving under the influence if he/she is drifting between lanes, stopping abruptly for no reason, swerving erratically while driving, driving at extremely high or low speeds or making excessively wide turns. If you were caught doing at least one of these things, you might just get pulled over and be arrested for DUI in Montgomery, Alabama.</p>
<p>During a DUI arrest, a driver is usually asked to do some tests to prove whether or not he/she has been driving under the influence. The first set of tests would be the Field Sobriety Tests (FST) to test the coordination and balance of the driver. The usual tests that are being done would be the Horizontal Eye Test, the Walk and Turn test, and the One Leg Stand. Each of these tests being conducted is designed so that a sober person will be able to pass without a problem. These tests do not provide the police officer with a specific blood alcohol level but they do allow the officer to pass judgment on the ability of the driver to operate a motor vehicle.</p>
<p>Once the police officer determines that the driver is intoxicated based on these FST, he/she will be asked to take the Breathalyzer test. The driver will breathe into the Breathalyzer and it will compute the blood alcohol level. The driver will be considered legally intoxicated if your blood alcohol is 0.08 or higher. If the driver fails the FST and Breathalyzer, he/she will be read his/her rights and arrested. He/she must remain in jail until someone posts bail and he/she receives a court date for sentencing.</p>

<p>The breath test is usually being done by a machine which is called the Breathalyzer. The Breathalyzer is so simple to use that the individual would just have to breathe in the machine and after that, it will show the police officer the blood alcohol content (BAC). If the individual fails the test, he/she you will be brought in for further BAC testing which includes urine or blood BAC test.</p>
<p>The Breathalyzer is a very important tool to police officers who actively search for motorists who are drunk driving. It actually gives them yet another simple way to determine whether or not an individual is driving with too much alcohol in his or her system.</p>
<p>In the state of Alabama, the breath analysis test can be used against someone charged with DUI. But as they say, the results of the breath tests are not perfect, but they can be indication of whether or not an individual is driving with a BAC that is above the legal limit. If someone who is charged with DUI is working with a DUI lawyer, the lawyer may be able to prove that the test results were inaccurate.</p>
